Assets Tracing Gyre enters the market of distressed indebtedness with the aim of providing bespoke advice to clients on how to enforce their claims toward debtors in the most cost-effective and timely manner.

We will help our clients analyze their current position and evaluate with them chances at mediation, as well as looking into the development of a strategy for formal enforcement of an overdue indebtedness. Acting strategically and as quickly as possible will maximise the chances of success in any case involving asset tracing and recovery.

On top of that, we are especially proud of being able to advise our local and overseas clients on various aspects of structuring IP assets from scratch, covering all the steps from the very moment of the proper acquisition of the asset, through its effective licensing management, to the moment of its liquidation. Our experience here is mostly focused on entertainment (movies, TV series, games, online dating platforms), and in addition we have a solid understanding of advising enterprises running messengers and exploiting trademarks throughout various jurisdictions.
Experience & Practices
Reasons for outstanding indebtedness, in terms of financial liability, may vary substantially, based on, and conditioned by, different elements, such as:

  • the overall economic, industrial and political environments, which might impact business and even the healthiest financial abilities;
  • the paucity of securities (be it the surety of an enterprise’s beneficial owner or a regular pledge);
  • the behavior of a beneficial owner, since it’s not an uncommon case to have a nonperforming loan resulting from to the deliberate decision of the owner not to settle what is due.

Regardless of the reasons for non-performance, and providing that there is no room for amicable resolution of the matter, a proper strategy of enforcement has to be developed, keeping into account such factors as:

  • the nature of the specific arrangement in question (e.g., a contractual arrangement, tort, damages, fraud, etc.) and the governing law to apply;
  • the amount due;
  • the jurisdiction of both the creditor and the debtor;
  • the indebtedness status (i.e. whether it has already been adjudicated, or not);
  • the location of the ultimate asset.

This exercise is of great value. By parsing the above factors together, the Assets Tracing Gyre team is able to determine the most suitable strategy in terms of how and where to proceed, whether to approach investigative vehicles or not, and how to instruct a legal counsel in a subject jurisdiction.

With a degree in law and years of practice as manager in the industrial sector, Natalia is able to frame a problem from different angles, analysing both the purely legal side of a case and its strategic exposure from a potential enforcement perspective. An excellent communicator, Natalia uses her negotiations skills to examine any chance of mediation, in addition to getting engaged into developing a strategy of formal enforcement of an overdue indebtedness.

Andrea Dell’Agnese, Lead Analyst
Andrea is an inter-disciplinary (applied geophysics and engineering background) senior data analyst with 15+ years of expertise in the development of advanced statistic / stochastic models.
By formation, Andrea is a geodesist who started his career working for the University of Udine (IT) helping to evaluate the subsidence of the North-Eastern Italian regions. Later, he worked for the University of Bolzano (IT), developing statistical models to study the dynamics of rivers and precipitation patterns in high-mountain basins of the Alpine Arch, and picking up also teaching at the University. Recently, before joining the team, he worked on signal analysis tied to hydraulic engineering, and as GIS data analyst.
Andrea has a Master Degree in Environmental Engineering, obtained at the University of Trieste (IT) in 2008; a second level Master qualification in Analysis, Evaluation, and Mitigation of the Hydrogeological Risk obtained at the University of Udine (IT) in 2009; and a PhD in Management of the Mountain Environment, obtained at the Bolzano University (IT) in 2014.
